By accessing or using ClickAlchemy ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

ClickAlchemy is operated by Quant Alchemy ("we," "us," or "our"), a Colorado-based company. By using the Service you confirm you are at least 18 years old and have the legal authority to enter this agreement.

ClickAlchemy is an AI-powered content optimization platform for YouTube creators. The Service uses artificial intelligence to generate titles, descriptions, and thumbnail images, and provides analytical feedback designed to help improve video performance. Features are accessed via a credit-based subscription system.

These tools are intended for informational and creative-assistance purposes only. We do not guarantee any specific outcome, view count, revenue, or growth as a result of using the Service.

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate, current, and complete information during registration and to update it as necessary. We reserve the right to suspend or terminate accounts that contain false information or that violate these Terms.

The Service operates on a credit system. Credits are allocated monthly based on your subscription plan and are consumed each time you use a paid feature. Credits do not roll over month to month and have no cash value.

Paid plans are billed in advance on a monthly basis. All fees are non-refundable except where required by applicable law. We reserve the right to change pricing with at least 30 days' notice to active subscribers.

Payments are processed by our third-party billing provider (Stripe). We do not store your full payment card details.

ClickAlchemy does not guarantee any specific outcome, including but not limited to increased views, subscribers, revenue, or engagement, as a result of using the Service. AI-generated content is provided as a creative aid and does not constitute professional advice of any kind. Users should conduct their own evaluation before publishing any AI-generated content.

You agree not to use the Service to:

• Generate content that is illegal, defamatory, or violates any third party's rights
• Violate YouTube's Terms of Service or Community Guidelines
• Impersonate any person or entity or upload images of individuals without their consent
• Transmit any malware, viruses, or other harmful code
• Circumvent, disable, or interfere with security features of the Service
• Reproduce, duplicate, copy, sell, trade, or resell access to the Service without our express written permission
• Use automated means to access the Service beyond what is explicitly permitted

The Service uses artificial intelligence to generate titles, descriptions, and thumbnail images. AI-generated content may contain inaccuracies, may not reflect your unique voice, and is not guaranteed to achieve any particular result. You are solely responsible for reviewing, editing, and publishing any AI-generated content.

You retain ownership of content you upload to the Service (e.g., persona images). You grant us a limited, non-exclusive license to process your uploaded content solely to provide the Service. We do not use your content to train AI models without your explicit consent.

AI-generated outputs are provided to you and you are responsible for determining whether they are appropriate for your use and compliant with applicable laws and platform policies.

ClickAlchemy may use YouTube API Services. By using YouTube-related features, you additionally agree to be bound by the YouTube Terms of Service. Your use of YouTube data via the Service is subject to Google's Privacy Policy.

All content on ClickAlchemy, including its design, code, branding, and original content, is owned by Quant Alchemy or its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our written permission.

"ClickAlchemy," "ClickScore™," and "One-Click Fix™" are trademarks of Quant Alchemy.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL ACHIEVE ANY PARTICULAR RESULT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUANT ALCHEMY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR ANY AI-GENERATED CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold Quant Alchemy, its officers, directors, employees, and agents harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) content you upload or publish through the Service; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

You may cancel your subscription and delete your account at any time from your account settings. We may suspend or terminate your access if you violate these Terms, with or without notice.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

Quant Alchemy reserves the right to amend these Terms at any time. If we make material changes, we will notify you by email or by posting a notice in the Service. Your continued use of the Service following any changes constitutes acceptance of those changes.

These Terms shall be governed by the laws of the State of Colorado, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Larimer County, Colorado.
